Terms of Service
Last updated: 14 October 2026
This document is a translation of the French original. In the event of any discrepancy, the French version prevails.
These terms, which also include the privacy policy, set out the rules for using the services offered by cysol OÜ, publisher of CYSOL POS (see the legal notice).
By ticking “I accept” or by using the service, you acknowledge that you have read and understood these terms, and that you accept them on behalf of the person or business for which you use the service.
If you do not accept these terms, do not use the service. All rights not expressly granted in them remain the property of the publisher.
We may amend these terms. Any material amendment will be notified to you at least thirty days before it takes effect, by email or by a notice in the service. If you do not accept it, you may cancel before that date; continuing to use the service afterwards constitutes acceptance. However, an amendment required by law, by a restrictive measure (sanctions) or by a change in a country's tax rules may apply without notice. The version in force and the version history are shown on this page.
Definitions
- Authorised user — any person whom the customer authorises to use the service on its behalf: its staff, but also any person to whom it discloses its login credentials, and for whom it is answerable.
- Content — text, images, sounds, videos, documents and information present in the application or on the website.
- Customer — the person or business that creates a CYSOL account. If you create an account for a business, you represent that you have the authority to bind it; it is the business that is the customer.
- Personal data — any information relating to an identified or identifiable person: name, identity number, email address, postal address, telephone number, employment data, bank details, or any other element allowing that person to be identified directly or indirectly.
- Sensitive data — data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic or biometric data, health, sex life, or criminal convictions.
- The service — the CYSOL POS till, its back office and all the features we offer, available at cysolpos.com. Your use of the service is subject to the limits of the plan you have chosen.
- We — cysol OÜ, publisher of the service, which operates the CYSOL POS brand.
- You — the customer and, depending on the context, its authorised users.
Account information
To use the service, you must have the age and legal capacity required to enter into a contract in the country where you operate. The service is intended for professional use.
You undertake to provide accurate, complete and up-to-date information, and to correct it if it changes. We use it to contact you: it is important that your contact details, and those of your authorised users, remain valid.
Use of your account
We grant you a limited, non-exclusive, non-transferable and revocable right of use, for the purposes of your business and in accordance with these terms.
You are responsible for everything that happens in your account: changes made and data entered or viewed, including by your authorised users. You control their level of access at all times and may change or withdraw it, at any time and without having to give a reason.
If you are an employee using the service on behalf of a business, it is your responsibility to make sure that you are authorised to do so. If you are the customer, it is your responsibility to authorise access, and you shall indemnify us against any claim relating to the use your users make of it.
In the event of a disagreement between a customer and one of its users about access, it is the customer who decides. Our obligations are owed to the customer alone.
Account closure
We may close or suspend your account at any time, with written notice. Closure then takes effect at the end of the period already paid for.
We may do so immediately if:
- you seriously or repeatedly breach these terms;
- you declare a country other than the one in which your business operates, or you circumvent the rules in the section “Countries, sanctions and tax obligations”;
- the law or a restrictive measure (sanctions) requires us to do so;
- providing the service in your country would become unlawful;
- we decide to withdraw the service from your country;
- you exceed the limits of your plan and do not remedy the situation;
- your use jeopardises the security or availability of the service for other customers, or uses a disproportionate amount of resources.
A suspension or closure imposed for any of these breaches does not entitle you to a refund of the current period, except in the cases provided for in our refund policy or by applicable law. Where the law requires it, we cooperate with the competent authorities.
You may close your account whenever you wish, from your back office or by writing to contact@cysolpos.com.
Closing an account and cancelling a subscription are two different actions. Cancelling stops the renewal and returns you to the free plan, while keeping your data. Closing the account ends the entire service and triggers the deletion of your data at the end of the period stated when you make the request. If you only want to stop paying, cancel: that is enough, and nothing is lost.
A closure requested before the end of a period already paid for does not give rise to a refund for that period, except in the cases provided for in our refund policy or by the law that applies to you.
When you request the closure of your account, it remains usable for the period stated when you make the request, after which your rights of use end. When we close or suspend an account for any of the reasons above, access may end immediately. To the extent permitted by law, we are not liable for any losses resulting from the end of access: it is your responsibility to export or back up whatever you need before closure.
Closure does not release you from any amounts owed before that date.
Who provides the service
The service is provided to you by cysol OÜ, publisher of CYSOL POS. We are your point of contact for everything concerning it: how it works, your data, your account, your subscription and support. These terms govern the use of the service.
The Pro subscription is sold to you by cysol OÜ, which issues the invoices. Payment is processed by Stripe, our payment service provider: you enter your payment details on its secure page, and they never reach us.
Prices and taxes
Prices are shown on the website. The Starter plan is free and has no time limit. The Pro plan costs €9.90 per month per business, excluding tax, whatever your country.
Where value added tax or an equivalent tax is due in your country, it is added to this amount. It is calculated on the checkout page based on your billing address, and the total, including tax, is shown to you before you confirm the payment. Stripe, our payment service provider, collects it and remits it to the tax authorities.
We may change our prices or introduce new plans, giving you thirty days' notice. The new prices apply on expiry of that period, unless you choose to stop beforehand. They apply immediately if you change plan on your own initiative.
You remain responsible for the taxes applicable to your business — those of your own trade — and shall indemnify us against any claim by a tax authority in that respect.
Payment and renewal
The Starter plan requires no payment method: it is free and stays free. The Pro plan trial does not require one either.
The Pro subscription is monthly and renews automatically each month, at the price then in force, until it is cancelled. It is paid in advance, on Stripe's secure page; your bank details never pass through our servers. Each payment gives rise to an invoice, which you can find in the subscription section of your account.
If you subscribe during your free trial, or during a period already paid for, the remaining days are added on: the first charge is made when they run out.
If a payment fails, it is attempted again over a few days. If it does not succeed, the subscription ends and your business returns to the Starter plan — without any data being deleted.
Cancellation and change of plan
You may cancel at any time, from the “My subscription” screen in your back office, without having to write to us or give a reason. The subscription has no minimum term.
Cancellation takes effect at the end of the period already paid for, not on the same day: you keep all your modules until the end of the period you have paid for. Until that date is reached, you can reverse your decision with a single click, without paying again.
At the end of that period, your business returns to the Starter plan: the management modules, the additional devices and staff, and history older than thirty days are no longer accessible.
No data is deleted in this case. It is the viewing window that closes, not your data: it all becomes accessible again if you switch back to the Pro plan.
Refund terms are set out in our refund policy.
Integrations with delivery platforms
The Integrations module links your business to a delivery platform (for example Uber Eats): its customers' orders arrive on your till, and your menu, prices and sold-out items are sent to it automatically. An order only goes into preparation once it has been accepted on the till.
Each integration is a separate subscription, on top of the Pro plan: €5.00 a month, excluding tax, per business and per platform. It is only available to businesses whose Pro subscription is paid — neither on the Starter plan nor during the free trial. The rules on taxes, payment, renewal and cancellation above apply to it in the same way, from the Integrations screen.
If your Pro subscription ends, your integrations stop working at the same time, and their subscription ends at the close of the period already paid, with no further charge.
An integration requires a merchant account with the platform, whose terms apply to your sales there. Its availability depends on the platform: we are not liable for an order lost, delayed or cancelled by it, nor for the commissions it charges you. The prices you display on the platform, any markup you choose and the commission rate you declare for your accounts are your responsibility.
Plan limits and fair use
Each plan has limits: number of devices, number of staff, how far back the history goes, access to modules. They are described on the website and may change; new limits apply from your next use.
We may ask you to upgrade to a higher plan if you persistently exceed the limits of your current plan.
We reserve the right to restrict or suspend an account whose use we consider unreasonable, or which degrades the service for others. Wherever possible, we will give you twenty-four hours' notice and ask you to reduce your usage before any restriction.
No warranty
The service is provided “as is” and “as available”. Your use of it is at your own risk.
We do not warrant that:
- the service will meet all your needs;
- it will operate without interruption, free of errors and with complete security;
- the results obtained will be accurate or reliable in all circumstances.
We may add, change or remove features. You may sometimes need to reload the application to benefit from them. Nothing in these terms guarantees that the service will remain available indefinitely, or in its current form.
Limitation of liability
To the extent permitted by law, we are not liable for any indirect damage, or for any loss of profits, revenue, goodwill or data, resulting from:
- the use of, or inability to use, the service;
- the cost of a replacement service;
- unauthorised access to, or alteration of, your data;
- the conduct of a third party using the service.
In any event, and to the extent permitted by applicable law, our total liability may not exceed the amounts you have actually paid us during the six months preceding the event giving rise to the claim. For a customer on the free plan, this liability may not exceed a nominal amount.
These limitations do not apply in the event of gross negligence or wilful misconduct on our part.
Your responsibility
You are responsible for all activity carried out from your account. You are responsible for keeping your password and your staff's codes confidential. We are not liable for any damage resulting from a failure to protect these credentials.
You shall indemnify us against any claim, action or expense resulting from the use made of your account or from any breach by you of these terms.
In particular, you shall hold harmless and indemnify cysol OÜ against any claim, fine, penalty, damage or cost, including reasonable legal fees, resulting from a false declaration of country, from any use of the service not permitted by these terms, or from your failure to comply with your tax or legal obligations.
Acceptable use
You undertake not to:
- use the service unlawfully or fraudulently, or in breach of these terms;
- infringe our intellectual property rights or those of a third party;
- disseminate defamatory, offensive or shocking content;
- use names of a sexual, racist or insulting nature;
- damage, overload or compromise our systems, or interfere with other users;
- collect data from the service or attempt to intercept communications with our servers;
- disclose another user's information to a third party, or use it for commercial purposes without that user's express consent;
- create accounts by automated means;
- process personal data in breach of the legislation applicable to your business;
- access the service for the purpose of competitive analysis, or to develop a competing service;
- carry out vulnerability or performance testing without our prior written consent;
- automatically extract our prices, our customer lists or any other data for commercial purposes.
Countries, sanctions and tax obligations
Countries where the service is not offered
The service is not offered in countries and regions subject to restrictive measures (sanctions) of the European Union, including Russia, Belarus, North Korea, Iran, Syria and Cuba, nor in the regions of Ukraine that are not under the control of the Ukrainian government: Crimea, Sevastopol and the occupied areas of the Donetsk, Luhansk, Zaporizhzhia and Kherson regions.
You may not use the service from these countries or regions, for a business located there, or if you, your business or any person who owns or manages it appears on a sanctions list of the European Union or the United Nations.
Countries where use is limited to management
In Spain, Germany, Portugal, Croatia, Slovenia, Slovakia, Poland, Hungary, Romania and Greece, CYSOL POS is not authorised as a cash register or as invoicing software. In these countries, you may use the service only to manage your business, in particular payroll, time tracking, staff, the menu and QR menu, stock and reports. You undertake not to use it to take payments, or to issue or print receipts or invoices.
We may update this list at any time, in particular when a country's tax rules change. The list in force is the one shown on this page.
The service is not a certified fiscal device
Unless expressly stated otherwise on this page for a given country, CYSOL POS is not a fiscal device, a certified cash register or approved invoicing software. It is not connected to any system of a tax authority.
Your tax obligations
You are solely responsible for complying with all your tax, accounting and invoicing obligations in your country: use of a certified cash register where the law requires it, transmission of data to the tax authority, electronic invoicing, retention of records and data, or any other local obligation.
As between you and us, you alone bear the fines, penalties and other consequences of any failure to comply with them, including where you use the service to take payments or issue receipts in a country where this is not permitted.
Accurate declaration of country
You warrant that the country declared for each business is the one in which it actually operates, and you will inform us without delay of any change.
A false declaration of country, the use of a virtual private network (VPN), a false address or any other means intended to circumvent the rules in this section is a serious breach of these terms, for which you alone bear the consequences.
No fraud
The service must not be used to conceal, delete or alter sales, or to commit or facilitate tax fraud. We are not liable for any fraudulent, unlawful or unauthorised use of the service that a customer makes without our knowledge.
Compliance
cysol OÜ conducts its business in accordance with European Union law and Estonian law, including the restrictive measures (sanctions) of the European Union. We may refuse a registration, or suspend or close an account, where these rules so require.
Intellectual property
The service, its code, its interface, its trade marks and its graphic elements are protected by copyright and other applicable legislation. They remain our exclusive property.
You undertake not to copy, modify, decompile or disassemble the service, create derivative works from it, or assign any rights in it. Nothing in these terms constitutes an implied grant of a licence.
By publishing trade marks or protected content in the service, you warrant that you hold the necessary rights.
The data you enter remains yours. Products, sales, staff, settings: we claim no rights over it and use it for no purpose other than providing the service.
Data protection
We implement appropriate technical and organisational measures to protect the data you enter.
It is your responsibility to comply with the legislation applicable to your own processing. In particular, you must have informed your staff and obtained the necessary authorisations or consents — especially for their photographs — before entering their data in the service.
You must not send us any sensitive data as defined above.
Details of the processing are set out in our privacy policy.
Deletion of data
When your account is closed, your data is deleted after thirty days, unless a longer retention period is required by law. During that period, you may request an export of it.
After that period, any data retained for a legal reason is isolated and is no longer processed in any way.
Payment
We do not provide any payment, collection or money transfer service, and at no time do we hold funds on your behalf.
The service records the sales you enter in it; it does not process any bank card and does not connect to any payment terminal. Taking payment from your customers is entirely a matter for you and the means you use.
Security
We maintain the service in line with reasonable and generally accepted security standards: encrypted communications, passwords stored in irreversible form, strict separation between businesses.
You remain solely responsible for the security of your own devices, your local network, and the actions of your authorised users.
Governing law and jurisdiction
These terms, and any dispute arising from them, are governed by Estonian law, the law of cysol OÜ's registered office, unless a mandatory provision provides otherwise.
The parties will first seek an amicable solution. Failing agreement within thirty days, the dispute will fall within the exclusive jurisdiction of Harju County Court (Harju Maakohus), in Tallinn, subject to any mandatory rules on jurisdiction that may apply to you.
General provisions
Failure to require the performance of an obligation, or to exercise a right immediately, does not constitute a waiver of it.
The service is intended for professional use. You therefore do not act as a consumer, and the protective provisions specific to consumers do not apply.
Each clause is severable. If any clause were held to be unlawful or unenforceable, the others would remain in full force and effect.
Clauses which, by their nature, are intended to survive the end of the contract continue to apply.
You may not assign, transfer or sublicense these terms or the rights they grant.
We may work with partners or resellers to promote the service, and pay or receive a commission for doing so.
